Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the PsychDraft application and related services (the “Service”) operated by PsychDraft LLC (“PsychDraft,” “we,” “our,” or “us”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

1. Eligibility

PsychDraft is intended for use only by licensed clinicians, supervised trainees, and authorized mental health professionals operating in accordance with applicable legal, ethical, and professional requirements. By using the Service, you represent and warrant that you meet these requirements.

The Service is not intended for use by individuals under 18 years of age.

2. Nature of the Service

PsychDraft is an AI-assisted clinical drafting support platform designed to assist clinicians with documentation workflows, including organization and drafting of structured report language.

PsychDraft:

  • Is not a medical device
  • Does not provide medical advice, diagnosis, or treatment
  • Does not replace professional clinical reasoning, assessment, or decision-making

PsychDraft is designed to support clinician-authored documentation workflows and does not replace clinical reasoning, interpretation, diagnostic formulation, or professional decision-making.

All content generated through the Service must be reviewed, edited, and verified by the clinician prior to clinical use. You are solely responsible for the final clinical content and any decisions made based on it.

3. AI-Assisted Output & Limitations

PsychDraft uses artificial intelligence to assist with drafting and organization of clinical documentation.

  • AI-generated content may contain inaccuracies, omissions, formatting inconsistencies, or unintended language.
  • PsychDraft makes no representations or warranties regarding the accuracy, completeness, or reliability of AI-generated output.
  • Users are solely responsible for reviewing, editing, approving, and finalizing all output prior to clinical use.

4. Clinical Responsibility & Privacy

You agree that:

  • HIPAA-Conscious Design: PsychDraft is designed to support privacy-sensitive clinical documentation workflows using HIPAA-conscious infrastructure.
  • Clinician Responsibility: Clinicians remain responsible for ensuring appropriate use consistent with their organization’s policies, licensing requirements, applicable laws, and professional obligations.
  • Documentation Decisions: Clinicians retain responsibility for determining what information is appropriate to include in documentation workflows.
  • Privacy-Conscious Practices: Clinicians may choose to minimize direct identifiers when appropriate for their workflow or organizational requirements.
  • Platform Limits: PsychDraft acts solely as a drafting assistance tool and does not assume responsibility for users' regulatory compliance or clinical assessments.

5. Accounts & Security

You are responsible for maintaining the strict confidentiality of your account credentials, security tokens, and passwords, and for all activities that occur under your account.

You agree to implement reasonable security practices to protect your account access and to notify us immediately of any unauthorized access, breach of security, or suspicious account activity.

6. Subscription & Billing

PsychDraft operates on a subscription basis.

By subscribing, you agree:

  • To pay all applicable fees associated with your selected plan.
  • That payments are processed securely through third-party payment processors (e.g., Stripe).
  • That subscriptions renew automatically unless canceled prior to the renewal date.

You may cancel your subscription at any time through your account settings or billing portal. Cancellation will apply at the end of the current billing period.

Unless required by law, subscription fees are non-refundable.

7. Intellectual Property

The Service, including its software, design, and original content (excluding content you input), is the exclusive property of PsychDraft LLC.

You retain ownership of all content you provide or generate using the Service.

You may not copy, reverse engineer, distribute, or create derivative works of the Service without written permission.

8. Acceptable Use

Users may not:

  • Attempt to gain unauthorized access to the Service, other accounts, or computer systems connected to the Service;
  • Reverse engineer, decompile, disassemble, or interfere with the platform's core code, API mechanisms, or functional infrastructure;
  • Upload, transmit, or introduce malicious software, viruses, or harmful code to the Service;
  • Misuse the platform in violation of any applicable federal, state, local, or international laws;
  • Misrepresent professional credentials, licensure status, or authorization to use the platform;
  • Use the platform in any manner that is inconsistent with professional codes of ethics or legal obligations.

9. Termination

We may suspend or terminate your access to the Service at our discretion if you violate these Terms or misuse the platform.

You may terminate your account at any time.

10. Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, either express or implied.

We disclaim all warranties, including but not limited to:

  • Fitness for a particular purpose
  • Merchantability
  • Non-infringement
  • Accuracy or reliability

11. Limitation of Liability

To the maximum extent permitted by law, PsychDraft LLC, and its directors, employees, partners, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses arising from your use of the Service.

In no event shall our total liability exceed the amount paid by you to PsychDraft LLC in the preceding twelve (12) months.

12. Indemnification

You agree to indemnify and hold harmless PsychDraft LLC from any claims, liabilities, damages, losses, and expenses arising out of:

  • Your use of the Service
  • Your clinical decisions
  • Your violation of these Terms
  • Your violation of applicable laws or regulations

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.

14. Changes to These Terms

We may update these Terms periodically. Continued use of the Service after changes constitutes acceptance of the revised Terms.
